Terms of Service

1. Acceptance
By subscribing to or using The Clam AI ("Service"), you agree to these Terms. If you do not agree, do not use the Service. These Terms constitute a binding contract between you ("Client") and The Clam AI.
2. The Service
The Clam AI provides a managed AI assistant that processes WhatsApp messages on behalf of hospitality businesses. The Service includes configuration, hosting, and ongoing model maintenance. We reserve the right to modify features with 14 days' notice.
3. Subscriptions & billing
- Plans are billed monthly in advance.
- No long-term contract is required — you may cancel at any time before the next billing cycle.
- There are no setup fees.
- Price changes will be communicated 30 days in advance.
4. Refund policy
We offer a full refund if you cancel within 7 days of your first charge and the AI assistant has not yet gone live. Once the Service is live, charges are non-refundable for the current billing period, but you will not be charged again after cancellation.
5. Client responsibilities
- You must provide accurate business information during onboarding.
- You are responsible for maintaining your WhatsApp Business account in good standing with Meta's policies.
- You must not use the Service for unlawful, deceptive, or abusive communications.
- You are responsible for informing your guests that automated AI may respond on your behalf.
6. Limitation of liability
The Clam AI shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability in any 12-month period shall not exceed the fees paid by you during that period. The AI may occasionally produce inaccurate responses — you are responsible for reviewing critical operational decisions.
7. Intellectual property
The Clam AI retains all rights to the platform software, AI models, and infrastructure. You retain ownership of your business data and guest conversation content. Upon termination, your data will be exported to you within 48 hours.
8. Termination
Either party may terminate at any time. We may suspend the Service immediately if you violate these Terms. On termination, access is revoked at end of the billing period and data is purged after the retention period defined in the Privacy Policy.
9. Governing law
These Terms are governed by applicable law. Disputes shall be resolved by binding arbitration or in the courts of competent jurisdiction. If any provision is held invalid, the remainder of the Terms continues in effect.
